Agreement
By using this website or requesting services from U-PULL-N-POUR, INC (“Company”), you (“Customer”) agree to these Terms & Conditions.
You represent that you are at least 18 years of age and have the legal authority to enter into this agreement.
All services are subject to availability and scheduling confirmation by phone.
Scheduling, Cancellation & Rescheduling
Orders are scheduled by phone. Delivery and pickup times are approximate and not guaranteed. The Company reserves the right to cancel
or reschedule due to weather, equipment issues, supply availability, or unsafe site conditions. If the Customer needs to cancel or reschedule,
please call as early as possible. Cancellation terms, including any applicable fees for late cancellations or no-shows, will be communicated
at the time of scheduling.
Customer Responsibilities
The Customer is responsible for: (a) ensuring the jobsite is ready before the scheduled delivery or pickup, including forms, subgrade,
reinforcement, and safe access for equipment; (b) obtaining any required permits and inspections; (c) verifying that the property and
access route can safely support the weight and size of the Company’s equipment; and (d) providing accurate project specifications,
including quantity, mix strength, and any add-ons. The Customer is solely responsible for all concrete placement, finishing, curing,
and post-delivery handling.
Property Access & Damage
By requesting delivery, the Customer grants the Company permission to access the specified property with its equipment.
The Customer represents that they have authority to grant such access. The Company will exercise reasonable care, but is not liable
for damage to driveways, lawns, landscaping, underground utilities, irrigation systems, septic systems, or other property features
caused by normal equipment operation or pre-existing site conditions (including soft ground, inadequate surfaces, or concealed hazards).
The Customer is responsible for identifying and marking any underground utilities, sprinkler lines, or septic components before delivery.
Concrete Performance & Warranty Disclaimer
Concrete performance depends on many variables beyond the Company’s control, including but not limited to: weather conditions,
subgrade preparation, water addition at the jobsite, finishing practices, curing methods, load conditions, and third-party work.
The Company provides concrete materials only. All services are provided “as is” without warranty of any kind, either
express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.
The Company does not guarantee specific PSI strength, finish quality, color consistency, or crack-free performance, as these depend
on factors outside its control. The Company is not responsible for defects, cracking, discoloration, or failures caused by customer
handling, site conditions, or third-party work.

referred party and accepts no liability for their performance, quality, or conduct.
Limitation of Liability
To the maximum extent permitted by Florida law, the Company’s total liability for any claim arising from its services shall not exceed
the amount actually paid by the Customer for the specific service at issue. In no event shall the Company be liable for any indirect,
incidental, special, consequential, or punitive damages, including lost profits, property damage beyond the service area, or project delays.
Indemnification
The Customer agrees to indemnify, defend, and hold harmless U-PULL-N-POUR, INC, its owners, employees, and agents from any claims,
damages, losses, or expenses (including reasonable attorney’s fees) arising from: (a) the Customer’s use of the concrete
or services; (b) conditions at the Customer’s jobsite; (c) injury to persons or damage to property occurring at or related to
the Customer’s project; or (d) the Customer’s breach of these Terms.
Force Majeure
The Company shall not be liable for delays or failure to perform due to causes beyond its reasonable control, including but not limited to
severe weather, natural disasters, equipment breakdown, supply shortages, road closures, government orders, or other unforeseen circumstances.
Governing Law & Disputes
These Terms are governed by the laws of the State of Florida. Any dispute arising from these Terms or the Company’s services shall be
resolved in the courts of Lake County, Florida. If any provision of these Terms is found unenforceable, the remaining provisions shall
remain in full force and effect.
Changes to These Terms
The Company may update these Terms from time to time. The effective date at the top of this page indicates when the current version took effect.
Continued use of the website or services after changes constitutes acceptance of the updated Terms.
